Cuccinelli discusses where President Obama’s legislation directly violates the Constitution.
The first is textual. Article I, Section 8 of the Constitution provides that “the Congress shall have Power . . . To regulate Commerce with Foreign Nations, and among the several States.” Although there have been disputes about just how far this should reach into commerce that is entirely intrastate, until now, it has been recognized that this constitutional provision deals with regulation of commerce — that is, with the use of law to impose reason and order on the voluntary commercial actions of citizens, as well as on activities that substantially affect commerce. An individual mandate to purchase health insurance is not regulation in that sense.
Virginia recently passed legislation which specifically states that residents of the Commonwealth are not mandated to have health insurance. This legislation was signed into law by Governor Bob McDonnell, and the new health care law would be in direct violation of Virginia law. Currently, Cuccinelli has a lawsuit in federal court challenging the unconstitutionality of the new law.
Attorney General Ken Cuccinelli was one of the first to file a lawsuit on behalf of the Commonwealth of Virginia challenging the constitutionality of President Obama’s health care bill, which was signed into law yesterday.
Of course, this has garnered the ire of Virginia Democrats, as they have decided to create a petition to demand Cuccinelli stay focused on being an Attorney General, as well as accusing Cuccinelli of wasting money on frivolous lawsuits.
Cuccinelli is fighting to defend Virginia’s health care freedom laws and uphold the Constitution…which means he’s doing his job, right? Also, the cost for Virginia to file a lawsuit challenging the unconstitutional Obama health care plan is $350, while Obama’s health care plan will cost Virginians $1.1 billion over 12 years.

Attorney General Ken Cuccinelli is prepared to challenge President Obama’s health care plan (if it is passed and signed into law) on the grounds that it violates the 10th Constitutional Amendment and Virginia’s health care freedom laws (thanks to Del. Bob Marshall’s (R-Manassas) HB 10). Cuccinelli recently made appearances on MSNBC and Fox News to discuss the potential challenges.
Personnel is policy, whether it be conservative or liberal. The Obama administration has used its heavy hand in every facet of our lives. That is why it is so important that our political action committee has the success it has had in placing conservative, pro-life, pro-family people in leadership positions in both the federal and state governments. We are being rewarded by the candidates in the state of Virginia like Ken Cuccinelli who understands why we supported him. Life will not be easy for him as he stands up for the principles and policies he was elected to uphold, but we will keep him in our prayers and thank him as we do now for his correct interpretation of laws that pertain to discrimination.
The Washington Post reported on March 6 that Attorney General Ken Cuccinelli has asked Virginia public colleges and universities to rescind anti-discrimination policies that include protection based on sexual orientation, because it is not covered by Virginia law. (The Virginia General Assembly has rejected such a change over the years, and again as recently as this month.) All of the largest Virginia schools have such policies which mainly relate to the hiring and admissions processes. Homosexual activist groups and some student groups have protested the change.
This is a live report from Richmond, Va. In less than an hour and a half, the Commonwealth of Virginia will have a new Governor and Attorney General.
Right now, there are several dignitaries in attendance to witness the swearing-in. Maryland Governor Martin O’Malley is here, in addition to Virginia’s former Governors.

Update: 11:33 a.m. The stands are beginning to fill with people. The Governor will deliver his remarks at 12:30 p.m. His remarks reference his upbringing in Fairfax County and creating opportunities for all Virginians.

Governor-elect Bob McDonnell, Lt. Gov. Bill Bolling, and Attorney General-elect Ken Cuccinelli will be sworn into office on Saturday, Jan. 16, 2010 at noon at the State Capitol in Richmond. The inauguration is open to the public. Tickets may be purchased for the Balls and other official events in Richmond and other VA cities.
Today, two polls were released showing that November 3rd could provide a GOP victory for all three statewide offices. Both the Survey USA and the Public Policy Polling polls show McDonnell, Bolling, and Cuccinelli leading their opponents by double digit percentages.
Well, we are really getting into the home stretch for the 2009 elections. Here are the newspaper endorsements that each of the Republican candidates have received.
According to a recent Public Policy Polling poll, all three Republican statewide candidates now hold comfortable leads over their opponents.
Bob McDonnell is leading Creigh Deeds, 52-40%. This poll also concurs that the negative attacks by Deeds against McDonnell’s thesis are not working with Virginia voters.
In the race for Lieutenant Governor, Bill Bolling still leads Jody Wagner. Bolling had a 49-39 lead over Wagner.
Meanwhile, Ken Cuccinelli is really holding a wide margin lead over Steve Shannon in the Attorney General’s race. Cuccinelli is leading Shannon, 52-37.
All of these votes have a margin of error of 3.8%.
